Terms and Conditions

1. General provisions

1.1. These Terms and Conditions govern purchases from DiagnosticTools.eu and the rights and obligations of the Buyer and Seller.

1.2. Seller: MB DIAGAS, company code 304744405, VAT No. LT100013905416, Dubijos str. 11, Šiauliai, Lithuania, e-mail info@diagnostictools.eu.

1.3. Mandatory consumer-protection rules apply to consumers. Special consumer rights do not apply to purchases made for business or professional purposes unless required by law or separately agreed.

2. Formation of the contract

2.1. The Buyer selects goods, provides the required order and delivery information and confirms the order.

2.2. Before submitting the order, the Buyer can review and correct the entered information.

2.3. The sales contract is concluded when the Seller confirms the order by e-mail, unless the confirmation expressly states otherwise.

3. Prices and payment

3.1. Prices are shown in euros. Where applicable, prices including VAT and informative prices excluding VAT are displayed.

3.2. Orders are currently paid by bank transfer against a pro forma invoice unless another method is offered during checkout.

3.3. The order is processed after payment is received unless otherwise agreed.

4. Products and availability

4.1. The Seller seeks to keep descriptions, prices and stock information accurate; some data may be synchronised with suppliers.

4.2. If an ordered item cannot be supplied, the Seller will inform the Buyer and offer an alternative or refund the amount paid for the unavailable item.

5. Delivery

5.1. Goods are delivered using the method selected at checkout; DPD courier delivery may be offered.

5.2. Delivery price and any estimated time are shown during checkout. Unless otherwise agreed, consumer orders are delivered within the period required by applicable law.

5.3. If a parcel is visibly damaged, the Buyer should document the damage where possible and contact the Seller promptly. Acceptance of a parcel does not itself remove statutory consumer rights concerning defects.

6. Consumer right of withdrawal

6.1. Unless a statutory exception applies, a consumer may withdraw from a distance contract without giving a reason within 14 days.

6.2. Withdrawal may be notified by a clear statement sent to info@diagnostictools.eu or through the DiagnosticTools.eu online withdrawal form. The Seller will promptly acknowledge an electronically submitted withdrawal by e-mail.

6.3. The consumer must return the goods no later than 14 days after notifying withdrawal, unless applicable law provides otherwise.

6.4. The consumer normally bears the direct cost of returning conforming goods unless the Seller agrees to bear it or the law requires otherwise.

6.5. Refunds are made within the statutory period. Where legally permitted, the Seller may withhold reimbursement until the goods are returned or evidence of dispatch is supplied, whichever occurs first.

6.6. The consumer is liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

6.7. Statutory exceptions apply, including certain made-to-order goods and digital content whose supply has begun with the consumer's prior express consent and acknowledgement of loss of the withdrawal right.

7. Defective goods and statutory guarantee

7.1. Lithuanian statutory consumer remedies apply to defective goods. The statutory consumer guarantee for goods generally lasts 2 years from delivery.

7.2. A Buyer reporting a defect should provide order information and, where possible, a description and supporting material.

7.3. A manufacturer's commercial warranty does not remove or restrict statutory consumer rights.

8. Cancellation

8.1. The Buyer may request cancellation before dispatch. Where a consumer exercises a statutory distance-contract withdrawal right, Section 6 applies.

8.2. No non-statutory administration or restocking fee is charged to a consumer for a lawful withdrawal.

9. Liability

9.1. The parties are liable in accordance with applicable Lithuanian law. Mandatory consumer rights are not limited by these Terms.

10. Personal data

10.1. Personal data is processed for order administration, delivery, accounting, customer support and other lawful purposes as described in the DiagnosticTools.eu Privacy Policy.

11. Complaints and disputes

11.1. Questions and complaints may be sent to info@diagnostictools.eu.

11.2. The Seller responds to a consumer's written complaint with a reasoned response within 14 days unless the law provides otherwise.

11.3. If the response is unsatisfactory or is not provided on time, a consumer may apply to the Lithuanian State Consumer Rights Protection Authority (VVTAT) under the applicable procedure.

12. Final provisions

12.1. Lithuanian law applies, without depriving consumers of mandatory protection applicable in their country of residence where relevant.

12.2. The Seller may update these Terms. The version in force when an order is submitted applies to that order.
